Terms of Use

ARTICLE 1: Object

The present "Terms and Conditions", called T&Cs, define the terms and conditions of use of the whiskylodge.com Website.

The Website is owned by the limited liability company THE WHISKY LODGE, located 7, rue Ferrandière in LYON 69002, FRANCE, represented by its current manager, Pierre TISSANDIER, referred to as the Publisher. In this capacity, Pierre TISSANDIER is the Website's editorial director.

Any person using the Website is referred to as the User.

The Terms and Conditions of use of the Website define the services available on the Website and the manner in which the User uses the Website and its services.

Every User must agree to the general Terms and Conditions prior to connecting to the Website. This agreement is formalised when the User checks a box on the homepage of the Website.

ARTICLE 2: access to services

The User of the whiskylodge.com Website has access to the following services:

- Purchase of alcoholic and non-alcoholic beverages and other related products

- Information on the the Whisky Lodge products

- Creation of an online account

Any User with access to the Internet can access the Website free of charge. The costs incurred by the User to access the Website (internet connection, computer equipment, etc.) are not borne by the Publisher.

The following services are only accessible to Users if they have a customer account and are identified with their login details:

Personal information and data;

Management of billing addresses;

Order history and details;

Access to credit notes and vouchers;

Opinions and comments.

The Website and its various services may be interrupted or suspended by the Publisher, in particular for maintenance purposes, without him being obligated to give prior notice and/or justification and without him incurring any liability.

There may be hyperlinks on the whiskylodge.com Website that direct the Users to third-party Websites.

The use of hyperlinks means that the Users leave the whiskylodge.com Website as soon as they click on the link.

ARTICLE 3: Responsibility of the User

The User is sole responsible of the login and password.

The User assumes full responsibility for the use of information and content on the Website whiskylodge.com.

Any use of the service by the User that results directly or indirectly in damages may be subject to compensation from the competent court in favour of the Publisher.

By posting opinions or comments on the Website, the User expressly waives all intellectual property rights, and thereby authorises the Publisher to represent, reproduce, broadcast and distribute them, directly or through an authorised third party.

ARTICLE 4: Responsibility of the Publisher

The Publisher uses all reasonable means at his disposal to ensure access to the Website 24 hours a day, seven days a week, except in the event of force majeure, the occurrence of an event beyond the control of the Publisher, provided the maintenance operations necessary for the Website to function efficiently have been undertaken, or in the event of breakdowns. The Publisher shall not be held liable in the event access to the Website were impossible.

No technical assistance is provided to the User, by any means whatsoever.

The Publisher reserves the right to interrupt, temporarily suspend or modify access to all or part of the Website without prior notice, in order for the Website to operate efficiently or for any other reason, without the interruption resulting in any obligation or compensation of any kind.

ARTICLE 5 : Intellectual property

The content of the whiskylodge.com Website (still or animated images, trademarks, logos, graphic design, photographs, texts, data, graphic elements, videos, etc.) is protected by copyright, under the French Intellectual Property Code.

Any reproduction, imitation or use, in whole or in part, of the content without the prior authorisation of the Publisher constitutes a violation of the prohibitions set out in Articles L.713-2 et seq. of the French Intellectual Property Code and renders the author liable.

The WHISKY LODGE, ORCINES, BHLAS trademarks are protected by law under the conditions set out by the French Intellectual Property Code. The domain names whiskylodge.com, whiskylodge.fr are registered.

ARTICLE 6: Personal data

Users provides personal information when they register to the Website.

The electronic address (e-mail) of the Users may be used by the whiskylodge.com Website to communicate certain information and manage the account.

The Publisher guarantees the respect of the Users’ privacy, in accordance with Act n°78-17 of January 6, 1978 on data processing, data files and individual liberties and the General Data Protection Regulation (GDPR) of the European Union n°2016-679.

Pursuant to Articles 39 and 40 of the act dated 6 January 1978, the Users have the right to access, rectify, delete and oppose their personal data.

ARTICLE 7: Evolution of the general Terms and Conditions

The Publisher reserves the right to modify the clauses of these general Terms and Conditions at any time and without justification, in strict compliance with laws and regulations applicable at the time of the modification.

ARTICLE 8: Applicable law and jurisdiction

The present T&Cs are subject to French law. Any dispute arising out of the interpretation, validity and consequences of these T&Cs shall fall within the exclusive jurisdiction of the Lyon Court of Justice.
